In July, 1911, H. E. Samuel died, and tbe following November a suit was filed in tbe Mercer Circuit Court' for a settlement of bis estate. In this suit tbe appellant filed six claims against bis estate, amounting, in tbe aggregate to $3,700. One of these claims was an open ac-. count for services rendered to bim as clerk.
