Jack Wallace (plaintiff) brought an action against Jack Snider (defendant) in which he sought an injunction prohibiting defendant from denying him use of a roadway across property owned by defendant. Plaintiff sought a determination that he was entitled to use the roadway by reason of a provision in the warranty deed by which defendant acquired the real estate across which the road traverses (Count I) or, alternatively, that plaintiff had acquired a prescriptive easement to use the roadway (Count II).
