The courts are always ready to protect the person and property of infants and persons of unsound mind. When a person is incapable qf representing himself,_ either as a plaintiff or d.efqnd.ant in. an auction *59or special proceeding by reason of his infancy, it has long been the practice to allow a next friend or guardian to represent such person in such action or proceeding, and the judgment or order obtained in an action or special proceeding so conducted is binding upon such infant.
