The three plaintiffs, Judith Carroll, Heather Hart-shorn, and Ellen Frith, claim that they were sexually assaulted by the defendant, James Marzilli, and appeal from an order denying their motion for a preliminary injunction, which sought relief not only on behalf of themselves but for all women of the Commonwealth. For the reasons discussed below, we conclude that the requested pretrial relief pursuant to the Massachusetts Civil Rights Act (MCRA) was properly denied.
