Appeal from an order of the Supreme Court (Hummel, J.), entered August 30, 2007 in Columbia County, which denied plaintiffs motion for summary judgment.

In May 2006, the parties entered into a contract whereby defendants agreed to sell plaintiff certain real property with plaintiff giving a down payment of $35,000 upon execution of the contract. A subsequent title search uncovered four judgments recorded against defendant Richard W Coon.
