In this action the plaintiff seeks to recover for the loss of certain personal property which he claims that the defendant had insured against loss or damage by fire in the amount of $1000.00. In his complaint the plaintiff alleges that on October 28,1942, in consideration of the payment by the plaintiff to the defendant of a premium to be paid at the time the rate was determined by the def endant,' the defendant made its policy of insurance in writing, thereby insuring the plaintiff against loss or damage by fire in the amount of $1000.00 on household and personal effects…
