This is the second appeal of this case. See State, ex rel. v. Citizens National Bank (1930), 91 Ind. App. 106, 170 N. E. 346. It was an action to recover from the appellee, the proceeds of ten warrants issued to Lincoln School Township, St. Joseph County, Indiana, which appellee paid to the then duly elected, qualified, and acting trustee of Lincoln Civil Township, said county and state, under circumstances hereafter set out, who misappropriated the funds received from said warrants to his own use.
