OPINION
{¶ 1} Appellant Scott Bennett appeals the denial of his request for postconviction relief and reconsideration of judicial release in the Muskingum County Court of Common Pleas. The relevant facts leading to this appeal are as follows.
{¶ 2} In May 2002, appellant was indicted by the Muskingum County Grand Jury on (1) one count of aggravated robbery, a felony of the first degree; (2) one count of theft, a misdemeanor of the first degree; and (3) kidnapping, a felony of the first degree.
