would grant the writ application.

h Contrary to the majority, I would grant the writ application, finding that plaintiff submitted sufficient evidence regarding the standard of care to defeat summary judgment. Plaintiff, Daisy Ballard, filed suit against defendant, alleging a wrongful death claim (in addition to other claims) arising out of her mother’s, Mrs. Alma Noble Stubbs, eventual death following a fall while she was a resident at Harvest Manor.
