BACKGROUND

The penultimate issue in this action is whether there is substantial evidence in the record to support the conclusion of the Commissioner of Social Security (“Commissioner”) that the physical impairments suffered by plaintiff Jose R. Cruz did not render him unable to engage in gainful employment, and thereby eligible for supplemental security income (SSI) under Title XVI of the Social Security Act, 42 U.S.C: §§ 1381-1383(e), until July 1, 1993.
