Appeal from a judgment of the County Court of Schenectady County (Hoye, J.), rendered May 18, 2005, upon a *963verdict convicting defendant of the crime of robbery in the first degree.

In April 2004, a robbery was committed at a Dunkin’ Donuts restaurant in the City of Schenectady, Schenectady County, by a man brandishing a handgun with a laser sight.
