Soloff, J.), entered February 15, 1985, dismissing indictment number SN7239-84, which charged defendant Kenneth Ballou with one count of criminal sale of a controlled substance in the fifth degree (Penal Law § 220.31) and two counts each of criminal possession of a controlled substance in the fifth and seventh degrees (Penal Law § 220.06 [1]; § 220.03), unanimously reversed, on the law, and the indictment reinstated.
