The instant application was filed by the Government for a review of the decision and judgment of a single judge, sitting in reappraisement in Intercontinental Fibres, Inc. v. United States, 64 Cust. Ct. 618, R.D. 11692, decided January 22, 1970 on rehearing, and holding that export value, as represented by the entered values contended for by the importer-appellee, constitutes the proper dutiable value of nylon yarn exported from Italy and entered at the port of Hew York.
