Cross appeals from an order of the Supreme Court (Nolan, Jr., J.), entered March 31, 2010 in Saratoga County, which granted defendants’ motion to dismiss the complaint.
In 1998, plaintiff and defendant Saratoga Glen Builders, LLC entered into a contract for the purchase and sale of real property, the rights of which were subsequently assigned in 2004 to defendant J. Lucarelli Land Development, Inc.
