This is an appeal from an order of the Circuit Court of Baltimore -City overruling exceptions to an auditor’s account, and finally ratifying and confirming the account in so far as it allowed a dividend upon the claim of the appellee, filed in the receivership proceedings of Thomas O. Basshor Company, a corporation, pending in that Court. The evidence was taken in open Court, and although the record is quite large, exhibiting great conflict upon a number of questions of fact, the legal principle which should control the case is well recognized and its application free from difficulty upon the…
