RICHARDS, Circuit Judge.

The defendant, Michael Sullivan, is a contractor, who for many years has been engaged under contract with the government in deepening and widening the channel in the *47Detroit river, at a point commonly known as “Dime Kiln Crossing.” This work necessitates the use of large quantities of dynamite for blasting the rock which forms the bed of the river at this point. It appears that this work is still going on, and there will likely be spent by the government in ibis neighborhood for this purpose about $6,000,000.
