Appellant, Bryan Stallworth, sued his former appointed criminal counsel, appel-lee Randall Ayers, for breach of contract, breach of fiduciary duty, gross negligence, and violations of the Deceptive Trade Practices Act (“DTPA”) arising from his conviction in a criminal case. Ayers moved for dismissal under Texas Rule of Civil Procedure 91a, arguing that Stallworth’s suit had no basis in law. The trial court granted the motion and dismissed the case.
