The defendant was accused by the grand jury of Los Angeles County of the murder, on August 23, 1924, of Nina and May Martin, eight and twelve years of age respectively. The jury found him guilty of murder in the first degree and fixed the penalty at death. He was sentenced accordingly and has appealed from the judgment of conviction and from the order denying his motion for a new trial.
