KENYON, Circuit Judge.

Plaintiff in error was convicted on two counts of an indictment, the first charging him with unlawful possession of intoxicating liquor in the city of Bristow, Creek county, state of Oklahoma, a place within the limits of what had been Indian Territory prior to the admission of Oklahoma into the Union, and where the possession of intoxicating liquor is and was prohibited by federal statutes.
