The defendant, when called upon to plead to an information lodged against him by the United States attorney, charging him with unlawfully possessing liquor and maintaining a nuisance under the National Prohibition Act, pleaded autrefois convict, in which plea he sets up that on August 30, 1922, the collector of internal revenue of this district assessed against him, under section 35 of the Act of October 28, 1919, a penalty of $8.33 as a retail liquor tax, further penalties amounting to $841.66, and an additional penalty of $42.08, and that thereafter, and on December…
