In an action to recover damages for breach of contract, the plaintiff appeals, as limited by its brief, from so much of an order of the Supreme Court, Suffolk County (Berler, J.), dated December 16, 1997, as denied its motion for summary judgment.
Ordered that the order is affirmed insofar as appealed from; and it is further,
Ordered that, upon searching the record, the defendant’s cross motion for summary judgment dismissing the complaint is granted, so much of the order as denied the cross motion is vacated, and the complaint is dismissed; and it is further,
