— We take from the brief of counsel for the appellant, the following statement of the case:

“July 9th, 1878, the appellees, Perrin and Weibers, filed their petition, asking an order for the sale by them, at private sale, of certain realty described, and, also, the Lafayette Journal newspaper property, consisting of engine, presses, type, paper, etc., and the good-will.
“An order was entered for sale, at public or private sale, ■ of all said realty and personalty in such parcels or parts as the administrators may deem advisable, all sales to ‘be reported to the court for confirmation.’ An…
