On January 7, 1908, Rose Pecararo, the appellee, in company with her mother, was passing along the sidewalk in front of No. 16 Milton avenue, in the city of Chicago, and was injured by falling through a trap-door in the sidewalk. The premises belonged to the appellant, Halberg. The appellee sued the appellant and the city of Chicago in the municipal court. Upon a trial a verdict was returned against both defendants.
