This is an appeal from a judgment in a suit to set aside an award of workers’ compensation benefits by the Texas Industrial Accident Board.

Lawrence Mariner (appellee) sustained neck injuries on November 5, 1975 in the course and scope of his employment as a journeyman pipefitter. He filed a claim with the Industrial Accident Board for workers’ compensation benefits.
