This action is before this court on appeal from the judgment of the court óf common pleas of this county, and in a petition filed in the ordinary form the plaintiff alleges therein that he is the owner in fee of the undivided one-fifth part of certain real estate described therein, in said county, containing 120 acres. That said real estate descended from his father, *581Benedict Gross, now deceased; that the defendants Annie List, Fannie Y. Gross and John H.
