MORROW, Presiding Judge. —

The offense is murder, punishment fixed at death.

From the testimony of Mrs. C. P. Jones, widow of the deceased, the following synopsis is taken: She and the deceased had been married for about twelve years, though they had been separated part of the time. She had known Banks for about nine years, he having worked for the family, and also for her and her husband. The deceased was a station agent for a railroad company and lived about a mile from the courthouse.
