— The record having been perfected, the appeal is reinstated and the case considered on its merits.

Shortly after the noon hour on June 23, 1930, two men entered the Donley County State Bank of Clarendon, Texas, and, exhibiting pistols, took from Holman Kennedy, the cashier, $8,000 in money. The four persons in the bank at the time of the robbery positively identified appellant as being one of the participants in the commission of the offense.
