KELLY, Judge.

Plaintiff, Jerry Robinson, sued defendant, Poudre Valley Federal Credit Union (the Credit Union), to recover damages arising from non-delivery of an automobile financed through the Credit Union. The Credit Union counterclaimed for the balance due on the note. Robinson appeals the trial court’s adverse decision on his claims, and the Credit Union cross-appeals the trial court’s disposition awarding it less than the balance due. We affirm in part, reverse in part, and remand for a determination of damages.
