The order of the Appellate Division should be affirmed, with costs.

Petitioner Thomas Tierney was employed by respondent Office of Mental Health (OMH) as a Safety and Security Officer 2 (SS02). He was assigned to the Hudson River Psychiatric Center in Dutchess County and represented by petitioner New York State Correctional Officers and Police Benevolent Association, Inc. (NYSCOPBA).
