In this taxpayer’s action, the defendants move to dismiss the complaint pursuant to paragraph 7 of subdivision (a) of rule 3211 of the Civil Practice Law and Rules, and the plaintiff moves for summary judgment, pursuant to rule 3212 of the Civil Practice Law and Rules.

Briefly stated, the complaint alleges: that an agreement entered by the Nassau County Executive and the defendant Andrew Fabrizio on or about August 1,1963, wherein the county authorizes Fabrizio to operate and manage an outdoor golf driving range at Nassau County Park in Salisbury, County of Nassau, from July 26, 1963 to July…
