Respondent Kathleen Amelia Milender1 obtained a default divorce from appellant Wayne Donovan Milender. The default judgment was entered on October 22, 1990, and the district court filed its findings of fact, conclusions of law and decree of divorce on December 6, 1990.2 Almost eight months later, on July 29, 1991, the district court granted Wayne’s NRCP 60(b)(1) motion to set aside the default divorce decree.
