BINGHAM, Circuit Judge.

This is an. action to recover damages for personal injuries, which the plaintiff sustained, due to a fall while passing over a common stairway at the entrance of the defendant’s building in North Conway, N. H. There was a trial by jury, and a verdict and judgment for the plaintiff.

The defendant was the owner of a one- ■ story building in North Conway, leased to tenants. One portion of it was occupied by the Conway Wood Heel Company, one of its subsidiaries, for manufacturing purposes. The greater portion of the balance of the building was divided into offices, one of…
