The plaintiff, as executor and trustee, has a declaratory judgment determining certain legal rights of the parties. Florence L. Lester, the widow of the testator, has appealed.

Prior to August 30, 1917, Frank H. Lester was in the fruit business, and it appears that he was in some financial difficulties. He had conveyed certain property to the nominees of the Irving National Bank as collateral security for a loan. These conveyances included the home at 38 Linden avenue and premises situated on Greene avenue,' in Brooklyn. His wife, Florence L. Lester, did not join in these conveyances, thereby…
