Plaintiff-appellant, Johnie J. Simmons (“Simmons”), brought suit against defendant Chicago North Western Transportation Company (“the Company”) under the Federal Employers’ Liability Act, 45 U.S.C. § 51, et seq., alleging the Company’s failure to provide a safe working environment. Simmons appeals the judgment, entered upon a jury verdict in favor of the Company, and from the district court’s 1 denial of Simmons’s Motion for a New Trial.
