MEMORANDUM OPINION AND ORDER

MATSCH, District Judge.

These two lawsuits challenge the authority of the National Park Service (“NPS” or “Park Service”) to control access to a portion of a roadway within the boundaries of the Colorado National Monument (“Monu ment”). Jurisdiction over the controversy is provided by 28 U.S.C. § 1331 because the pivotal legal issues involve interpretation of pertinent federal statutes.
