*7Judgment unanimously modified, on the law, and, as modified, affirmed, without costs, in accordance with the following memorandum: In March 1978 former Utica Mayor Stephen Pawlinga appointed respondent Anthony De Salvatore to the position of Commissioner of the Board of Water Supply of the City of Utica for the remainder of the term of a former Commissioner, which expired on December 31, 1978. On January 5, 1979 he reappointed respondent to this position for a term expiring on December 31,1983.
