This is an action to recover a sum alleged by respondent to be due him by the appellant, as balance of his salary as Chief of Police of the Town of Cayce. The complaint alleges that respondent was elected Chief of Police of the Town of Cayce in July, 1934, for a period of two years at a salary of $86.00. per month. His election was by the action of the duly constituted council of the Town of Cayce, a municipal corporation and body politic under the laws of South Carolina.
