Affirming.

This is the second appeal of this case. The opinion on the former appeal, where may he found a statement of the facts and applicable law, is reported in 201 Ky. 784, 258 S. W. 663.

On the first trial, the present appellant recovered a verdict against the present appellee in the sum of $15,-000.00. The judgment on that verdict was reversed in the opinion above referred to on the ground that the present appellant had' assumed the risk of the injury he had sustained.
