These two appeals were argued and briefed together in this court and both will be disposed of in this opinion.

W. Wallace Damron, Sr., a resident of Owensboro, Kentucky, was killed in an automobile accident in Belle-ville, Illinois, on August 1, 1941. He died intestate the owner of a large personal estate, as well as considerable real property. The appeal of Mrs. Gertrude Hall Damron is from that part of the judgment of the chancellor holding that she was not the widow of Mr. Damron, and the appeal of the administrator and the heirs of Damron is from…
