This action is brought by the assignee of the Exhibitors’ Herald, a trade paper circulated among moving *497pictures theatres in United States and Canada, to recover on a contract for advertising a moving picture film. Performance by the plaintiff is not questioned. The defendant asserts that it is not bound by the contract, because its president, John L.
