This matter is before the Court on defendant’s Motion to Dismiss pursuant to Rules 12(b)(1) and (6) of the Federal Rules of Civil Procedure or, in the alternative, on a Motion for Summary Judgment pursuant to Rule 56, Fed.R.Civ.P.

The plaintiffs contend that due to the assault and battery, trespassing and invasion of privacy by an employee of the United States Army, as well as the negligence of the United States Army, they sustained damages in the amount of Four Hundred Forty Thousand ($440,000.00) Dollars.
