This in an election contest, in which the appellant contests the right of respondent to the office of county auditor of Cavalier county for the term which began April 3, 1911. The facts are not in dispute, and, briefly stated, are as follows: At the general election held in said county on November 8, 1910, the parties were opposing candidates for the office aforesaid, and the returns of the canvassing board show that appellant received 1,305 votes and the contestee 1,312 votes for said office.'
