Eddie Kent sued K.B. Alexander Co. of Texas, Inc. (KBA) and Keith B. Alexander (Alexander), individually, for breach of contract and fraud in the course of performance by KBA of a contract for construction of a car lot. Kent alleged KBA and Alexander obtained progress payments. from Kent based upon false payment .applications misrepresenting that subcontractors had been paid for their work on the project when they had not.
