FACTUAL AND PROCEDURAL HISTORY

This appeal raises a jurisdictional issue which seems not to have been addressed by any court of appeals in a reported opinion. The issue is whether an interlocutory district court order directing the Commissioner of Patents and Trademarks to cancel a trademark registration, in an action in which the Commissioner is not a party, is an injunction within 28 U.S.C. § 1292(a)(1) and therefore immediately appealable.
