This is an action brought in this Court by removal from the Superior Court of the State of Delaware, in and for New Castle County, on the ground of diversi*567ty of citizenship. The precise matter arises from a motion of ■ the defendant to dismiss the complaint. The questions present a combination of statutes as bearing upon the following facts.
