This appeal involves Frost’s right to the use of winter waters of Grouse creek in Box Elder County. The creek as it courses from the mountains flows in a southerly'direction. It is chiefly made up by what is called the left fork, or Darrah creek, and the right fork, or Cotton creek. The eultivatable and irrigable lands consist' of rather narrow strips along the forks and the main creek. Frost’s lands are north of the junction and between and along both sides of the two forks.
