On March 6, 1936, plaintiff filed a complaint in the circuit court of Cook county, the first count of which charged that on September 6, 1935, he was injured while crossing Lawrence avenue at a point west of north Ashland avenue in Chicago, due to the negligence of the defendant in operating a motor vehicle and while plaintiff was in the exercise of ordinary care for his own safety, and the second count of which charged the defendant with wilful and wanton conduct in operating the automobile, as the proximate result of which plaintiff was injured.
