This is an action in ejectment, brought by The Bio Grande Southern Bailroad Company to sustain its adverse filed in the United States land office against the' application of Levi Bonner for patent to the Loopton lode mining claim. The company claims a right of way one hundred feet in width on each side of the center line of its track across the territory claimed by the appellant under his location. In support of its claim the company introduced a plat of the route of the road filed in the land office in *447March, 1891, which was approved by the secretary of the interior, September 4, 1891.…
