People v. Levy

Appellate Court of Illinois

Decided September 26, 1990No. 1—87—1299Published

1Opinion of the Court

PRESIDING JUSTICE CERDA

delivered the opinion of the court:

Defendant, Levoyd Levy, was convicted of possession of a controlled substance with intent to deliver. (Ill. Rev. Stat. 1985, ch. 56V2, par. 1401(a)(2).) He argues on appeal that: (1) the trial court erred in denying his motion to quash arrest and suppress evidence because a false affidavit supported the warrant; (2) the expert testimony of a detective concerning the street value of the drugs was prejudicial; and (3) defendant was denied a fair trial when the judge commented on the nature of the testimony of a defense witness.
