Appeal by the defendant from a judgment of this court, entered upon a verdict in favor of plaintiff, rendered at a trial before Judge Joseph F. Daly, and a jury, and from an order denying a motion for a new trial. The facts are stated in the opinion.

The defendants were insurers in the sum of five thousand dollars, upon a policy of life insurance dated in December, 1870, and issued by them upon the life of Daniel Ladd, a resident of the State of Florida, payable to his legal representatives in sixty days after due notice and satisfactory proof of his death. He died October 20th, 1872, and due notice and satisfactorv proof of his death were given the defendants on the 19th of November, 1872, so that their obligation to pay the amount of the insurance money to the representatives of the insured, accrued on the 19th day of January, 1873.
